These Terms of Service ("Terms") govern your use of the services provided by Martial Solutions LLC ("we," "us," or "our"). By using our services, you agree to these Terms.
1. Services
Martial Solutions provides AI-powered voice agent services for businesses. Our services include:
- AI voice agents that answer calls on your behalf
- Call recording and transcription
- Lead qualification and appointment booking
- Integration with your existing business systems
2. Account Registration
To use our services, you must:
- Provide accurate and complete information
- Be at least 18 years old
- Have authority to bind your business to these Terms
- Keep your account credentials secure
3. Pricing and Payment
Subscription Plans:
- Starter: $397/month — AI voice agent with 7-day free trial
- Growth: $597/month — AI voice agent with CRM integration, calendar booking, knowledge base
- Enterprise: Custom pricing — unlimited calls
Setup Fee: $500 one-time fee, charged after delivery of your free prototype agent.
Overage Charges: Calls exceeding your plan limit are billed at $0.15 per minute.
Billing: Subscriptions are billed monthly in advance. Overage charges are billed at the end of each billing cycle.
Refunds: We offer a satisfaction guarantee during your first 30 days. Contact us for refund requests.
4. Free Prototype
We provide a free prototype voice agent before you commit to a paid plan. The prototype allows you to test our services with no obligation. If you choose to proceed, the $500 setup fee applies.
5. Acceptable Use
You agree not to use our services to:
- Violate any laws or regulations
- Make fraudulent, harassing, or abusive calls
- Impersonate others or misrepresent your identity
- Transmit malware or harmful content
- Violate telephone consumer protection laws (TCPA)
- Make unsolicited telemarketing calls without consent
6. SMS/Text Message Notifications
Program Name: Martial Solutions SMS Notifications
What you'll receive: By providing your mobile phone number during onboarding, you consent to receive automated SMS notifications from Martial Solutions related to your account. These include:
- Call summaries after your AI assistant handles an inbound call
- Service alerts for maintenance requests, guest issues, or time-sensitive events
- System notifications such as status updates and appointment confirmations
Message frequency: Message frequency varies based on your account activity. You can typically expect 1–10 messages per week.
Message and data rates may apply. Your mobile carrier's standard messaging and data rates apply to all SMS messages sent and received. Martial Solutions is not responsible for any charges from your carrier.
Opt-out: You may opt out at any time by replying STOP to any message from us. You will receive a one-time confirmation and no further messages will be sent. Opting out of SMS does not cancel your service — you will continue to receive notifications via email and other channels.

Consent: By signing up for Martial Solutions services and providing your mobile number, you expressly consent to receive recurring automated text messages at the number provided. Consent is not a condition of purchase. You may revoke consent at any time by texting STOP.

7. Call Recording Consent
Our AI agents may record calls for quality and training purposes. You are responsible for ensuring compliance with call recording laws in your jurisdiction. Our agents announce that calls may be recorded at the start of each call.
8. Intellectual Property
We retain all rights to our AI technology, software, and systems. You retain ownership of your business content, customer data, and call recordings generated through your use of our services.
9. Data and Privacy
Your use of our services is also governed by our Privacy Policy. You are responsible for obtaining necessary consents from your customers for data collection and call recording.
10. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for service interruptions due to maintenance, third-party failures, or circumstances beyond our control.
11. Limitation of Liability
To the maximum extent permitted by law, Martial Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities.
Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Martial Solutions from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
13. Termination
Either party may terminate the service agreement with 30 days written notice. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, your access to services will end, but data retention policies in our Privacy Policy will apply.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through our services. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of Colorado. Any disputes shall be resolved in the courts of Colorado.
